Session Agreement – Boys

  • By choosing "I agree" you (client) are agreeing to the terms and conditions set forth by Maria Vallejo Photography (Photographer) as stated herein.

    Session Reservation & Retainer
    The client shall make a non-refundable session retainer (also called session fee) to the photographer in order to reserve the time and date agree upon by both parties.. Session retainer must be received within 3 days of booking or the session date and time may be released for booking by other clients. Session date and time will be confirmed by photographer upon receipt of the session retainer/ fee payment and signed session agreement.

    If clients requests to reschedule the session, the session retainer shall be applied to a rescheduled date, subject to Photographer's availability.

    Rescheduled sessions may be assessed a $100 re-booking fee.

    Rescheduled sessions are subject to the Photographer's pricing and product list in effect at the time of re-booking.
  • In case that client is late arriving to the session, client understand and agrees that due t the nature of natural light photography, time late to the session may result in less time being available for the session, and that all planned outfits and poses may not be possible
  • The photographer shall make session proofs available through an in-person ordering appointment. This image premier and ordering appointment shall take place no later than 3 weeks for the portrait session

    Photographer shall present approximately 60 full edited images of the photographer's choice for client proofing. Though the photographer anticipates at least 60 available for proofing, this number cannot be guaranteed as every session is different, and some will render more than or less than 60.

    The photographer retains the right of discretion in selecting the images presented for proofing. RAW/unedited images are not available for viewing.

    All print/digital/photographic product orders must be place and paid for aththe image premier and ordering appointment. The minimum order amount is due at this time.

    * A restocking fee of $120 will be applied if you are unavailable to the POS within two weeks after your gallery is ready for you *
  • The photographer shall make session proofs available through an in-person ordering appointment. This image premier and ordering appointment shall take place no later than 3 weeks for the portrait session

    Photographer shall present approximately 30 full edited images of the photographer's choice for client proofing. Though the photographer anticipates at least 30 available for proofing, this number cannot be guaranteed as every session is different, and some will render more than or less than 30.

    The photographer retains the right of discretion in selecting the images presented for proofing. RAW/unedited images are not available for viewing.

  • The session fee price is $200
  • * $750 MINIMUM ORDER REQUIRED*

    Order Minimum/Payment All orders are due and payable at the image premier and ordering appointment.

    No form of photographic products will be released until the order is paid in full.

    Order selections can be made from the collections offered, or individual from the product boutique/ a la carte product list.

    The session fee/retainer is separate and is not included in the minimum order requirement.

    Payment may be made by check, credit card or cash. There is a $100 fee for checks returned for non-sufficient funds. In the event of a returned check. declined installment transaction or unpaid order, them minimum order amount will be charged to the credit card used for initial booking of the session. Any additional balance due may become immediately payable by cash, cashier's check or other credit card.

    Payment plans are available for purchases over $1,000. The minimum order is required as the down payment for all payment plans.

    All sales are subject to current state and local sales taxes.

    Due to the custom nature on photographic purchases, all sales are final.

    All credit card transactions, will have a 3% charge from the total value.

    Client has been provided a copy of Photographer's pricing menu prior to booking.
  • Makeup artists are independent contractors and are not employees of Maria Vallejo Photography. Maria Vallejo Photography, is not liable for any applications or services by this independent contractor. This includes but is not limited to allergic reactions as a result of use of the products by the independent contractor.

    It is the clients responsibility to convey all allergies to the independent contractor.

    Additionally, in the event client is unhappy with the makeup service being provided, it is incumbent upon the client to address such issues prior to leaving to the session. Upon notification of dissatisfaction, the independent contractor shall make a reasonable attempt to satisfy the client's preferences.

    Client understands that arriving late to the makeup appointment may result in the stylist not being able to accommodate the late arrival and that tardiness may result in the makeup services being unavailable. Missed services will not be refunded due to client's time late to the appointment.
  • All sessions are photographed on location, and using available natural light. Locations are determined after considering client preferences and photographer's expertise in creating a session meeting the artistic standards of the photographer.

    If, in the opinion of the photographer, inclement weather or other adverse conditions prevent the creation of a session meeting the artistic standard of the p photographer, photographer may elect to use an alternate location or reschedule the session.

    Client agrees that s/he has reviewed the photographer's website, blog, and /or other photographic works and is aware of the photographer's artistic style and representation of photographic images.

    If the photographer cannot perform agreed upon services due to fire or other casualty,struck act of God, or tother cause beyond the control of the parties, or due to photographer's illness or emergency, then the photographer shall upon written request return any session fee to the clients but shall have no further liability with respect to the contract. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera or media malfunction, lost in the mail or otherwise lost of damaged. In the event the photographer fails to perform for any other reasons, the photographer shall not be liable for any amount in excess of the real value of the client's purchase.

    The photographer shall be held harmless for any and all injury to client during the course of the photography session and the immediately surrounding events.
  • Client expressly releases the photographer from all claims, damages, injuries, and liabilities that may result from accidents or incidents that occur during the portrait session. This water of liability includes waiver of any claim that may be result of
  • The photographer shall own the copyright in all images created and shall have the exclusive right to make reproductions for, including but not limited to, marketing materials, portfolio entries, sample products, editorial submissions and use (in both digital and print formats) magazines and e-zines, contests submissions and use, or for display within or on the photographer's website and/ or studio. If the photographer desires to make other uses, the photographer shall not do so with out first obtaining the written permission of the client.

    The client signing this contract warrants that she or he has actual authority to agree to the use of the likeness of all persons included in the portrait in this manner and shall indemnify and decent the photographer in the event of litigation arising out of such use.
  • This contract incorporates the entire understanding of the parties. any modifications of this contract must be in writing and signed by both parties. The person signing this contract agrees to act as a representative of all people photographed, and represents their agreement to these terms and conditions.

    I certify that I am at least 18 years of age. I have read this portrait agreements and I fully understand the contents thereof. I agree that I have the legal authority to grant these permissions and accept all responsibility for such.
